The Senate Intelligence Committee is still negotiating with former national security adviser Michael Flynn to obtain documents for its counterterrorism investigation into Russian Federation and the us presidential election, congressional aides said on Thursday.

"General Flynn's lawyers said he will not honor the subpoena, and that's not a surprise to the committee", Burr said. "Consistent with the Committee's position since the beginning of [our] investigation, I welcome their willingness to cooperate".

For refusing to honor a Congressional committee's subpoena, Michael Flynn could be found in contempt of Congress.

The district court route would entail the Senate passing a resolution authorizing civil action that could lead to Flynn being charged with contempt of court.

Nina Ginsberg, a veteran Washington defense attorney with extensive experience in national security cases, said that without an ironclad immunity deal from the committee, Flynn would be exposed to questioning from investigators about any personal documents he gave up.

Richard Burr of North Carolina released a statement revealing that Flynn had yet to respond to a subpoena issued as part of the panel's investigation into the Russian government's alleged subversion of the 2016 election.

Flynn was sacked from his top post in the Trump Administration after just 25 days when it was revealed he had lied about his communications with Russian ambassador to the U.S. Sergey Kislyak and then misled Vice President Mike Pence about the conversations.

Senators slapped Flynn with a subpoena last week in their investigation into ties between President Donald Trump's campaign associates and Russian interference.

Amid Justice interest, Trump formally chose Flynn as his national security adviser. The U.S. has rebuffed those calls.
