Trump not included in Russia probe: lawyer

Trump has hinted that he may have taped conversations with Comey - conversations in which the ex-FBI chief says the president pressured him for his loyalty.

But Jay Sekulow, a member of the president's legal team, said on "Meet the Press" that Trump "is not and has not been under investigation for obstruction". So which is it? "As we know of today, the president is not under investigation".

Asked if Trump's social media commentary may be created to intimidate Rosenstein or Mueller, Senator Marco Rubio said "I have no basis to make a decision on what his intent is" but added that the tweets "in no way" will impede the work of the investigation. The result was that Rosenstein, a career prosecutor with no affiliation to Trump, unilaterally made a decision to appoint a special counsel and hired Mueller.

It is common for subjects of federal investigations not to know they are under scrutiny, especially in the initial phases.

The Post story cited five people briefed on the interview requests, who said that the current director of national intelligence, Daniel Coats, head of the National Security Agency, Mike Rogers, and Rogers's recently departed deputy, Richard Ledgett, agreed to be interviewed by Mueller's investigators. The Clintons, who were hardly ethically spotless to begin with, emerged from the ordeal politically unscathed-the GOP lost seats in the 1998 midterms, while Hillary was elected to the Senate in 2000-but habitually paranoid.

Trump's tweet was posted more than a day after a Washington Post story reported that "Five people briefed on the interview requests, speaking on the condition of anonymity because they were not authorized to discuss the matter publicly", confirmed that Special Counsel Robert Mueller, appointed to look into allegations that members of the Trump administration colluded with Russian Federation to interfere with the election, was investigating whether or not Trump had sought to obstruct justice.

But a new worry about Mueller is taking shape.

Wittes recalled the New York Times article about the dinner where Trump reportedly asked Comey for loyalty. "That s it. Simple explanation", Sekulow told CNN s "State of the Union". It hasn't wavered in its support for the president, and wouldn't do so in the event of a Mueller firing.

Sekulow responded that Trump had been getting at a "constitutional issue". Firing Comey was a grave mistake.

But Sekulow said repeatedly Sunday that "the president has not been and is not under investigation". Mueller was appointed by Deputy Attorney General Rod Rosenstein and has expansive powers to probe any matters that develop from his initial investigation. But is he right that Trump would be removed from office if he fires Mueller?

With no limits to the investigation, and with the president's pique leading to ready rationales for expanding the probe, Mueller and his team will inevitably find something. Cohen has worked for Trump since the mid-2000s and was active in the campaign. "He's not afraid of the investigation there is no investigation", Sekulow told NBC channel.
