In a huge blow to the detractors of Aadhaar push, Supreme Court has ruled that Govt. of India is correct in pushing Aadhaar for availing welfare schemes.

Additional Solicitor General Tushar Mehta appearing on Centre's behalf, also informed the bench that the government has already extended the deadline for getting Aadhaar from June 30 to September 30. However, the top court said those without Aadhaar cards could not be deprived of any government schemes or benefits till the next hearing in the case. The Bench comprising Justices A M Khanwilkar and Navin Sinha took note of the fact that the petitioner had not provided any data to substantiate the claim that children were being deprived of the mid-day meal scheme for want of Aaadhaar.

The Bench said, "No interim order can be passed in mandamus on mere apprehensions". The next hearing in the matter has been posted for July 7.

The apex court was hearing three separate petitions challenging governments notification making Aadhaar mandatory for availing benefits of various social welfare schemes.

The court referred to its June 9 verdict and said no further observation is needed in the matter pending before it.

Furthermore, everyone who has been allotted a PAN number and Aadhaar number or is eligible to obtain the same as of the aforementioned date, shall intimate his Aadhaar number to the income tax authorities for the goal of linking PAN with Aadhaar.

In the previous ruling made on June 9th, Supreme Court hadn't stopped Govt. from enforcing the Aadhaar-PAN Card linkage but refused to make the process compulsory, until Constitutional Bench decides on the privacy issue. Effective July 1st, Aadhaar Card number is mandatory for filing tax returns using PAN Card. The government also said because of Aadhaar, Rs. 49,650 cr had been saved in two years under the Direct Benefit Transfer Scheme, which was earlier being siphoned off through fake identities. Though the notification requires people to enroll for Aadhaar by June 30, those who are unable to get themselves enrolled due to lack of facilities, can give their contact details and would be registered later, said the Centre.

The Centre had on May 19, refused to extend the June 30 deadline for making Aadhaar mandatory for availing social scheme benefits. He further said the idea behind making Aadhaar mandatory for welfare schemes was that the benefit should not go to "ghosts" as was noticed in schemes like the public distribution system (PDS).
