Justice C V Karthikeyan in his order earlier in the day had dismissed a plea by P Vetrivel, MLA, a loyalist of sidelined AIADMK leader T T V Dhinakaran, seeking a stay on the meeting, and imposed a cost of Rs one lakh on him for "wasting" the time of the court.

Last month, the factions led by Palaniswami and Panneerselvam merged. It was his case that the same could only be called by the General Secretary of the party, a position last occupied by VK Sasikala, who is now undergoing a prison sentence for graft charges during Jayalalithaa's tenure.

The Election Commission froze the party's "two leaves" election symbol due to competing claims.

Accepting the submissions made by Senior Counsel C. Aryama Sundaram, representing Mr. Palaniswami, that preventing the meet would affect 2,140 members of the general council, the Bench said: "We see no impediment in law if the rival factions choose to get together and jointly convene a meeting".

Sasikala faction, T.T.V Dinakaran on 11 September said that the party faction is prepared to bring down the government of Tamil Nadu, if Chief Minister K Palaniswami is not changed.

In his plaint, Vetrivel, who supports now sidelined member TTV Dinakaran, sought to stay the meeting on the ground that the organisers could not call the said meeting under the banner of AIADMK.

According to the AIADMK leader, the meeting was called near here to abide by a party rule that mandates holding of the General Council meeting at least once a year.

Without getting the nod, Vetrivel has filed the suit, the judge said. The Bench said the meeting can "go on" and there is "no stay" while upholding the single judge's order. He termed it a condemnable practice wherein a "Should be plaintiff" is shown as the defendant so that he could effectively back-stab other contesting defendants at the opportune moment. The Madras High Court on Monday refused to entertain a last-ditch effort to stay the meeting of the General Council scheduled to happen in Chennai on Tuesday. The bench then posted the appeal to October 23 for further hearing.
