Manafort Sues Justice Department, Robert Mueller And Rod Rosenstein

Former Trump campaign chairman Paul Manafort filed suit against special counsel Robert Mueller, Deputy Attorney General Rod Rosenstein and the Department of Justice on Wednesday ― a suit that experts quickly said has little chance of success. The order allows Mueller to investigate any issues that "may arise directly from the investigation", giving him broad latitude.

At the time of the May 2017 appointment of Mueller, Rosenstein said, "It is in the public interest for me to exercise my authorities and appoint a special counsel to assume responsibility for this matter". As a constitutional matter, Manafort was charged with crimes not by Mueller or his team, but by the executive branch of the United States: that is, by President Donald Trump, acting through the Department of Justice.

Manafort's legal complaint seeks to overturn the indictment brought against him in October, saying that it has targeted aspects that are not linked to the investigation's official task.

In his suit, Paul Manafort accuses Mueller of exceeding his authority by investigating him for conduct that was not related to Russian interference in the 2016 presidential election.

Appearing before the House Judiciary Committee on December 13, Rosenstein was asked if Mueller had ever asked to expand the scope of the special counsel's investigation.

Manafort claims that "Even if that grant of authority were lawful, Mr. Mueller's investigation and the resulting indictment exceed it".

A third adviser in the Trump presidential campaign, George Papadopoulos, at the same time pleaded guilty to lying to the Federal Bureau of Investigation.

Manafort and Gates face a total of 12 criminal charges related to money laundering and failure to file federal disclosures.

After a year of exhaustive investigations, Mueller's team still has produced no evidence that the Trump campaign colluded with Russian Federation. Hence, Manafort argues that Mueller has overstepped his legal authority in investigating and charging Manafort.

His roster of clients, some with unsavoury reputations, included deposed Ukrainian leader Viktor Yanukovich, an ally of Russian President Vladimir Putin. They've pleaded not guilty. But it also authorizes Mueller to probe "any matters that arose or may arise directly from the investigation".

The suit likewise refers to the July FBI strike on Manafort's home, in which the unique insight group said it was looking for records of conceivable monetary wrongdoings dating to January 2006 - 10 years before the presidential battle Mueller is researching.

I don't believe it's ever wise for the Justice Department to shirk its own investigative duties and appoint a special investigator who doesn't have to answer to anyone. Manafort's lawyers have resounded the President's feedback that Mueller's examination concerning Russian interfering in the 2016 race is seeking after wrongdoings that never happened. He told a congressional committee last month that he had signed off on Mueller's investigative moves, including what fell within his authorized scope.
