Aadhaar not mandatory for NEET: SC tells CBSE

In a huge relief to thousands of students, a Constitution Bench of the Supreme Court on Wednesday stayed a CBSE notification that made Aadhaar or Aadhaar enrolment proof mandatory to register or appear for the National Eligibility cum Entrance Test (NEET) 2018. A 5-judge constitution headed by Chief Justice Dipak Misra directed the Central Board of Secondary Education (CBSE) to upload the information on their website. The seat at that point called the Attorney General for help with the issue.

Students will not be barred from appearing in any entrance examination, including NEET, for want of Aadhaar as the Centre on Wednesday agreed before the Supreme Court not to make the 12-digit unique identity number mandatory for exams till its validity is decided by the apex court. The Centre on Tuesday told the court that it is open to the idea of extending the March 31 deadline to link Aadhaar with bank accounts and other services.

Justice Chandrachud said regardless of whether the court held its decision on March 20, the banks and other services would have just 10 days left, which may be troublesome.

Another senior advocate, K.V. Viswanathan, complained that there was all-round panic in the country, particularly in the financial markets, as banks and other financial agencies were threatening people with disruption of services if Aadhaar linkage was not done by March 31.

"We may do it by the end of month to enable the petitioners in the case conclude the arguments", Venugopal said.

He further said that the Centre could extend the deadline again after the petitioner in the case said that the hearing in the case may not be completed by March 31. Responding to the AG's submission, Justice Sikri said the interim order was not passed on the premise that law was not framed at that time.
