Pres. Trump announces pick for Supreme Court nominee

U.S. President Donald Trump chose Brett Kavanaugh, a politically connected conservative judge, for the U.S. Supreme Court Monday, setting up a confirmation battle with Democrats as he seeks to shift the nation's highest court further to the right. According to Politico, part of the email read, "Judge Kavanaugh protects American businesses from illegal job-killing regulation".

"Kavanaugh has proven to be a staunch conservative who has relied on originalism and textualism while serving on the US Court of Appeals for the District of Columbia Circuit". He has overruled regulators on cases ranging from consumer protections to net neutrality 75 times and even ruled that the structure of the Consumer Financial Protection Bureau is unconstitutional. The American Family Association has already expressed its opposition to Kavanaugh, calling on the Senate to reject him.

If confirmed, the appellate judge would become the second young conservative jurist Trump has put on the top United States court during his first term.

In an article in the Minnesota Law Review (pdf), Kavanaugh also noted his position on Senate confirmation hearings-a process he'll soon be facing. Kavanaugh worked in the solicitor general's office under George H.W. Bush and later worked in the George W. Bush administration for several years, first as associate counsel to the president, then as senior associate counsel.

By keeping Scalia's seat open, McConnell gave Trump a head start in putting his own stamp on the high court, and the president acknowledged as much when Gorsuch was sworn in previous year.

White House Legislative Affairs Director Marc Short said he expects Kavanaugh to be in place by October 1, when the court's next term formally opens, and Majority Leader Mitch McConnell has said the Senate will vote to confirm Kennedy's successor in the fall.

"It will be very hard for Democrats particularly those in red states to vote against him, except for rank political motives", said Carrie Severino, chief counsel and policy director at the Judicial Crisis Network, a conservative legal organization. "Judge Kavanaugh clearly understands the proper role of a judge is to interpret the law as it is written and apply the law impartially".

There's buzz that he has plans to gut Roe V. Wade.

Kavanaugh says he will begin meeting with members of the Senate on Tuesday. "Trump did not move too fast in naming a nominee", said Trevor Burrus, a research fellow at the Cato Institute's Robert A. Levy Center for Constitutional Studies.

The nomination, if confirmed by the Senate, would represent one of the most consequential decisions of Trump's presidency.

By contrast, Senate Republicans were in the majority in 2016, when McConnell and his GOP colleagues blocked President Barack Obama's Supreme Court nominee, Judge Merrick Garland, for more than nine months, following the death of Justice Antonin Scalia. McConnell had said the victor of the presidential election should make the choice.

"And yet you have this political dilemma that stares, I think, you and Chuck Schumer really in the face as the two leaders, which is this: staying united to stop the Supreme Court pick could cost you red state senators", he said.
