Zimbabwe opposition on deadline to appeal election result

"For now, it will stay pending until the court challenge determination".

The Zimbabwe president Emmerson Mnangagwa has said that his country is open for business, but this new law - the Zimbabwe Democracy and Economic Recovery Amendment Act - could scupper those plans as far as the United States is concerned.

The electoral commission declared the Zanu-PF's Emmerson Mnangagwa had 50.8% of votes against the MDC Alliance's Nelson Chamisa's 44.3%.

Zimbabwe's Movement for Democratic Change opposition party arrived at court on Friday to lodge an appeal to try to overturn the results of the presidential election, which it alleges was rigged to ensure victory for Emmerson Mnangagwa. If it does this successfully, the court could order a recount or nullify the result altogether.

"The respondents have three days to respond to the court petition and the matter must be heard and be determined within 14 days from the day of petitioning, according to the Constitution. We have a good case and cause".

"There will not be any inauguration this Sunday until this matter has been resolved in the courts", said Chamisa's lawyer Thabani Mpofu said.

MDC must prove that any polling irregularities were widespread enough to change the outcome of the vote.

Chamisa wants the constitutional court to declare him the victor or call a fresh election, it is reported.

European Union observers said that the ZANU-PF candidate had benefitted from an "un-level playing field" and some voter intimidation, though global monitors largely praised the conduct of the election.

"On the basis of the evidence we have placed before the court, we seek in the main relief to the effect that the court should declare the proper victor and the proper victor is my client", Mpofu told reporters outside.

The party is demanding either fresh elections or the instalment of their candidate Nelson Chamisa as president.

"We are seeking a declaration to the effect that the presidential election was not properly conducted".

Zanu-PF secretary for finance Patrick Chinamasa earlier in the week revealed that the party has assembled a 12-man legal team to respond to the challenge.

The aftermath of the election has been marred by allegations of a crackdown on opposition members, including beatings and arrests.
