'Turn the Plane Around': Judge Stops Deportation During Emergency Hearing

A federal judge in Washington threatened to hold Attorney General Jeff Sessions in contempt of court Thursday after halting the deportation of a mother and daughter who were sent home in the middle of appealing their removal.

"This is pretty outrageous", U.S. District Court Judge Emmet G. Sullivan said. Turn that plane around and bring those people back to the United States'.

The judge also threatened hold to hold Attorney General Jeff Sessions in contempt of court, according to an ACLU attorney, although an order requiring a response to a potential contempt charge hasn't yet been issued.

The mother, known in court documents by the pseudonym Carmen to protect her identity, and her daughter were challenging Trump administration rules that largely bar the use of domestic and gang violence as the basis for asylum applications.

In June, Sessions vacated a 2016 Board of Immigration Appeals court case that granted asylum to an abused woman from El Salvador.

According to U.S. Immigration and Customs Enforcement (ICE), Sullivan's order meant the taxpayer wound up paying for a needless round-trip flight. The government, he learned, had just deported an immigrant mother and daughter who are plaintiffs in the lawsuit the judge was hearing over family separations.

DC District Judge Emmet Sullivan then blocked the administration from deporting the two plaintiffs while they are fighting for their right to stay in the USA - reportedly excoriating the administration and threatening to hold Attorney General Jeff Sessions in contempt. Some of Carmen's friends and co-workers have already been murdered, the ACLU claims.

The plane landed in El Salvador, but Carmen and her child were allowed to return to the United States.

Under the fast-track removal system, created in 1996 under President Bill Clinton, asylum seekers are interviewed by an asylum officer to determine whether they have a "credible fear" of returning home.

In June, the Trump administration determined that fleeing domestic violence and gang violence would no longer be accepted as a means for refuge in the United States.

Two of the children and their mothers were deported before the suit was filed.

During the hearing, the judge ordered a temporary stay on deporting the nine women and three children who filed the lawsuit, according to a court filing.

As Carmen is with a child, and, therefore, can not be held in a typical facility for adults or separated from her child under current policy, it is likely they will be released into the American interior, free, despite having failed their credible fear determination.

Sessions and other Trump appointees have dramatically shifted how the federal government speaks about asylum, going as far as to suggest in public communications the unproven claim that asylum is a routinely abused legal loophole.

The ACLU is using Carmen's story and the similar experiences of the other immigrants to challenge Sessions' ruling on asylum.
