Supreme Court refuses to hear case challenging California hide carry law

The Supreme Court rejected requests by the broadband industry and the Trump administration to vacate a lower court's 2017 decision that upheld the Obama-era net neutrality rules, which prohibited broadband providers from blocking or throttling traffic and from charging higher fees for prioritized delivery.

In doing so, government lawyers sought to bypass federal appeals courts that have yet to rule definitively on the Deferred Action for Childhood Arrivals program. The Supreme Court's rejection of this appeal ensures the D.C. Circuit's decision remains in the record as binding precedent for the FCC's authority to adopt strong net neutrality rules.

The FCC, under Chairman Ajit Pai, abolished net neutrality rules in June, adopting the deregulatory approach favored by the Trump administration and the telecommunications industry. While neither of the latter Justices cited a reason for dismissing themselves from the appeal, Justice Kavanaugh had been involved in the initial ruling while seated on the DC Circuit Court of Appeals. The Supreme Court this week stated it wouldn't be hearing the case (pdf).

Instead, the Supreme Court declined to do so. They give internet service providers greater power to regulate the content that customers access, are now the subject of a separate legal fight after being challenged by numerous groups that backed net neutrality.

"The Department of Justice should not have been forced to make this filing today - the Ninth Circuit should have acted expeditiously, just as the Supreme Court expected them to do - but we will not hesitate to defend the Constitutional system of checks and balances vigorously and resolutely", Attorney General Jeff Sessions said in a statement after the appeals were filed.

The legal battle over net neutrality will continue and could potentially reach the Supreme Court again in a separate case.

The administration's attempt to end the program past year was rejected by multiple federal courts and the Department of Homeland Security was ordered to continue accepting renewal applications while the case is adjudicated.

California has voted in new net neutrality laws, but the Department of Justice has taken legal action to prevent them from coming into effect in January.

The net neutrality repeal was a win for providers like Comcast Corp, AT&T Inc and Verizon Communications Inc.
