President Trump expected to sign executive order on asylum system soon

The asylum section of the Immigration and Nationality Act says a migrant is allowed to make a claim up to a year after arriving in the USA, and it doesn't matter how they arrive - illegally or through a border crossing.

Donald Trump's administration announced it will deny asylum to migrants caught crossing the Mexican border illegally.

They are meant to speed up rulings on asylum claims, instead of having migrants try to circumvent official crossings on the almost 2,000-mile (3,200-kilometer) border.

A group of Central American migrants, representing the thousands participating in a caravan trying to reach the USA border, undertake an hours-long march to the office of the United Nations' humans rights body in Mexico City, Thursday, Nov. 8, 2018.

Trump said he was sending 15,000 active duty military to the border to deal with the problem, in what former President Barack Obama called a political 'stunt.' The troops began laying barbed wire as the migrants traveled toward the US on foot. "So while immigration laws afford people various forms of protection, there's a violation of federal law in the manner these illegal aliens are entering the country".

Every year the U.S. admits more than 1.5 million foreign nationals, with the vast majority deriving from family-based chain migration, whereby newly naturalized citizens can bring an unlimited number of foreign relatives to the U.S. In 2016, the legal and illegal immigrant population reached a record high of 44 million. "It is illegal to circumvent that by agency or presidential decree", Omar Jadwat, director of the American Civil Liberties Rights Project, said. The Immigration and Nationality Act (INA 208 (b)(2)(C)) unambiguously states that ineligibility grounds for asylum established by regulation must be "consistent with" section 208 of the INA, which explicitly says that aliens may lodge asylum claims "not at a designated port of entry".

Over time, the number of asylum claims has jumped markedly in recent years, an indication the administration says immigrants are tailoring their responses to claim asylum without merit.

"Our asylum system is overwhelmed with too many meritless asylum claims from aliens who place a tremendous burden on our resources, preventing us from being able to expeditiously grant asylum to those who truly deserve it", said the joint statement. More than 7,000 active duty troops could eventually be deployed, Defense Department officials said. However, Trump's focus on the issue during campaigning for Tuesday's hotly contested midterm congressional elections was criticized as veering into immigrant-bashing and even racism.

Two senior administration officials that spoke to NBC News said that "of the [immigration] measures most likely to be approved by the president, all were likely to lead to a lawsuit".

"U.S. law specifically allows individuals to apply for asylum whether or not they are at a port of entry".

Last week, he said he would be taking steps to limit asylum claims.
